Abstract
Aim: The study aims to present a legislative model developed by the author that would enable confinements to be enforced outside penal institutions with electronic monitoring (reintegration custody). However, this idea raises a number of questions. Therefore, the paper employs a mixed methodology to investigate whether reintegration custody could be introduced as an alternative form of confinement enforcement, considering the current state of the Hungarian criminal justice and prison systems.
Methodology: The study is based on a mixed methodology, combining the literature review and quantitative analysis with qualitative methods. Interviews with practitioners in the Hungarian criminal justice and penal systems explore the applicability of the legislative model developed by the author in Hungary.
Findings: First, the article presents the author's idea that electronic monitoring could become an alternative form of confinement enforcement in Hungary. Then, it uses a mixed methodology to explore the dilemmas and regulatory and application issues that arise in connection with this concept.
Value: The article presents a unique, modern solution that considers international experience and, to a small extent, could be used to reduce the prison population in Hungary. The author comprehensively examines the applicability of this solution in Hungary. The synthesis of the literature review, quantitative analysis and qualitative (interview-based) methodology is perhaps the study's greatest value.
