Abstract

Abstract
Aim: The aim of the study is to examine in a complex way the criteria by which the European Court of Justice controls the compliance of Member States’ decisions with EU law when expelling another EU citizen from their territories.
Methodology: The study undertakes the analysis of the latest case law of the European Court of Justice and its reception by legal lireature.
Findings: The main finding of the study is that the European Court of Justice in its recent case law on expulsions uses the concept of social integration in such a way that it takes into account not only the rights of EU citizens under EU law, but also the fulfillment of obligations arising from the staus of EU citizenship. In this context, it is important both whether the EU citizen respects the social values enshrined in the criminal law norms of the host Member State (moreover, in its recent case law the CJEU assesses possible violations of European values in addition to breach criminal law), and whether the EU citizens meets the economic requirements of the Citizenship Directive (the so called good market citizen concept.)
Value: The topic examined in the study has not been previously studied in the Hungarian legal literature. In addition, as an EU citizen, Hungarian citizens residing in another EU Member State may be affected by the examination of expulsion decisions for compliance with EU law.
