Pre-expulsion detention of foreigners: Migration policy vs. fundamental rights – alternatives to detention

Abstract

Following an assessment of international human rights instruments and domestic law on standard and alternative means restricting fundamental rights before ruling on the pre-expulsion detention of foreigners, the author overviews the case law of the Hungarian Commissioner of Fundamental Rights.
