Absztrakt

Cél: A tanulmány célja a confirmation bias (megerősítési torzítás) büntetőeljárásban betöltött szerepének vizsgálata, különös tekintettel annak megjelenési formáira a nyomozati, ügyészi és bírói döntéshozatal során, valamint annak bemutatása, hogy ez a kognitív torzítás miként járulhat hozzá téves ítéletek kialakulásához.
Módszertan: A kutatás elsősorban jogdogmatikai és interdiszciplináris megközelítést alkalmaz, amely a büntetőeljárás-jog és a kognitív pszichológia eredményeit egyaránt integrálja. A tanulmány hazai és nemzetközi szakirodalom feldolgozására, valamint konkrét jogesetek elemzésére épül.
Megállapítások: A vizsgálat rámutat arra, hogy a confirmation bias a büntetőeljárás valamennyi szakaszában jelen lehet, és gyakran önmegerősítő mechanizmusokon keresztül torzítja a bizonyítékok értékelését. A torzítás hozzájárulhat az alternatív verziók figyelmen kívül hagyásához, a „tunnel vision” kialakulásához, valamint rendszerszinten is felerősödhet. Megállapítható továbbá, hogy a szakértői bizonyítás és a technológiai eszközök alkalmazása sem zárja ki a torzítás megjelenését.
Érték: A tanulmány hozzájárul a büntetőeljárás tisztességével kapcsolatos tudományos diskurzushoz azáltal, hogy a kognitív torzítások szerepét rendszerszinten elemzi. Eredményei elősegíthetik olyan eljárási garanciák és módszertani megoldások kialakítását, amelyek képesek mérsékelni a döntéshozatal torzulásait.
