Abstract
According to the Convention on the Rights of the Child, persons under 18 are regarded as a children, therefore their rights, needs and ‘best interest’ needs to be taken into account in every case. This also applies to criminal procedures. The author argues the new amendments to the Hungarian Code of Offences that authorize the detention of underage offenders are both ineffective and are un violation of the principles and regulations of international documents and practice.
